Terms and Conditions 

Please read through these Conditions of Sale carefully as they form the agreement under which MerchUs (we, us or our) will supply products and services to you.

It’s important to note that in our quest to offer the best merchandise many of the suppliers from whom we source our products operate under trade agreements. This means we are an agent for their line of merchandise, an arrangement whereby – technically – you are transacting with our supplier even though you are dealing through us. When buying products through us, from them, you will be subject to their terms and conditions, which will prevail over these Conditions of Sale if there is any inconsistency. MerchUs brand clients 

Where MerchUs is providing you a subscription plan merchandise solution for your community, club or festival we will endeavor to provide you with the highest customer service and efficiently deliver your designs, and shop front.

Delivery of your designs and shop front

Time frames for design delivery will be communicated to you as part of the plan you have chosen. The design completion date will depend on when we receive your assets (logo etc), the size of your design plan and the date of payment – however we will try to have the first stage of design back to you within two weeks from this time. As a guide on our delivery time frame: 

  • 2 weeks will be allocated for the design phase
  • 2 weeks will be allocated for the set up of your shop 

MerchUs does not accept any responsibility for design files provided. Files must be free from copyright and commercial license are in place. Don’t forget – any font used for a design on an item to sell, as well as, on your website, logo, or advertising needs a commercial license. All rights to the creative design work produced by us as part of your subscription package are owned by MerchUS and may be used to promote our services or products.

Delivery timeframes

Delivery estimates vary, based on a number of factors so we are unable to provide solid timeframes. However we’d be happy to provide an estimated delivery date before you place your order, so please get in touch.

Orders for a product will not be placed or dispatched until the product is paid for in full. All orders will be drop-shipped, there is no option for click & collect.

We currently have two streams of product sources – as a guide the first stream will be within one week and the second stream within 6 weeks (to metropolitan areas). This however will be set out in detail in each MerchUs package your community/club purchases. For Tasmania, Western Australia, and similar remote locations, it may take up to 7 business days longer.

In the event of a model or range change by a manufacturer we will endeavour to notify you as soon as possible and attempt to secure the product or offer the best alternative to equal or greater value. At the time of order, the estimated delivery date is determined based on existing factors affecting our delivery time schedule. We however are subject to supply chain delays and delivery delays based on external factors out of our control. As our service is print-on-demand, there are some instances we will not be able to refund your order and cannot be held liable for not doing so.

You and your customers will receive a delivery estimate and tracking details as soon as your order has shipped. 

Terms of Sale

Consumer guarantees, as set out by the Australian Competition and Consumer Commission (ACCC), apply to all sales.

Prices and Payment

MerchUs is registered for GST and so all pricing structures incur a GST payment. Regarding pricing mistakes or errors, we make every effort to ensure prices and product information displayed on our website, catalogues or advertisements are correct and up-to-date.

We accept no liability for products that are superseded prior to payment being made in full.

Subscription payments

As a MerchUs brand client, a transaction of payment means that you become our client and accept our Terms and Conditions. That you agree and authorise MerchUs to take automatic payment from the credit card you submit as per the schedule agreed to during sign-up. At the end of the agreed membership, the membership will automatically be renewed, unless a written request from an authorised delegate of your company is sent to MerchUs no less than 30 days before the subscription is due to be renewed.

When sign up to a plan with MerchUs you are agreeing to subscription period. Subscription payment will be taken monthly. Pre-paid, load as you go or top-up credit cards will not be accepted. If you require an invoice to be sent for electronic fund transfer then please let us know. The subscription total amount will be invoiced to you and once funds have cleared we will being the design phase for you project. 

Returns Policy

We have every confidence in the durability of our products, as we work closely with our manufacturer to ensure our quality assurance requirements are met. However, should your product be damaged on arrival, we’ll go ahead and arrange the return of the faulty product before we ship out your replacement. The end customer must inspect the item and lodge their claim for any misprinted/damaged/defective items along with photo’s of the damage and submit this within 3 business days from the confirmed delivery date. 

Subject to this clause, we will not accept any liability for superficial damage notified outside this 3 day period. 

MerchUs reserves rights to refuse returns at our sole discretion.

For packages lost in transit, all claims must be submitted no later than 2 weeks after the estimated delivery date. 

For the avoidance of doubt, this does not limit or exclude any rights you may have under the Australian Consumer Law.

How do I report a problem with my order?

  • You can report problems with an order by using our enquiry form on our website.
  • Fill in the form and choose the appropriate concern
  • Attache images of the misprinted/damaged/defective items with your customer name and address, invoice number 

Claims deemed an error on our part are covered at our expense.

Issues not considered a faulty product that are neither minor nor major problems include: change of mind – for example, the consumer no longer likes the colour of an item of clothing or buyer remorse – or a defect due to abnormal use.

  • Wrong Address: If you provide an address that is considered insufficient by the courier, the shipment will be returned to our facility. You will be liable for reshipment costs once we have confirmed an updated address with you (if and as applicable).
  • Unclaimed: Shipments that go unclaimed are returned to our facility and you will be liable for the cost of a reshipment to yourself or your end customer (if and as applicable).
  • Sealed Goods: We do not accept returns of sealed goods, such as but not limited to face masks, which are not suitable for return due to health or hygiene reasons. You hereby agree that any returned orders with face masks won’t be available for reshipping and will be disposed of.
  • Size exchanges: Please note that size exchanges will not be accepted, please consider the sizing chart available with items when being purchased and choose carefully. 

You must not assign any rights and obligations under these Conditions of Sale whether in whole or in part without our prior written consent.


That MerchUs have the right to showcase products that have been designed by MerchUs for our advertising use without prior approval from the business/organisation. We also reserve the right to terminate our contract with you or terminate your account with us.

This site is owned and operated by MerchUs, as registered Australian business under The Impact Crew Pty Ltd. Unless otherwise specified, all materials appearing on this site, including the text, site design, logos, graphics, icons, and images, as well as the selection, assembly and arrangement thereof, are the sole property of MerchUs.

You may use the content of this site only for the purpose of shopping on this site or placing an order on this site and for no other purpose.

No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without MerchUs prior written permission.

All rights not expressly granted herein are reserved. This Terms and Conditions shall be governed and interpreted in accordance with the English language, regardless of any translations made for any purpose whatsoever and in line with Australian Consumer Law.

Any unauthorised use of the materials appearing on this site may violate copyright and other applicable laws and could result in criminal or civil penalties.
